PSPやその他ゲーム機のハッキング行為は、違法行為なのでしょうか?
PSPにCFWを入れていると知人に話したところ、「あんた、そんな事してると逮捕されるよ」と言われて心配に
なりまして…。色々聞いてみても「合法では」という人と「違法だ」という人がいて結局のところどっちなのか

その知人はおそらく"CFW=ISOダウンロード"などの間違った認識をしているのでしょう。

違法行為ということは、

法律で禁じられている行為

であり、ゲーム機でハッキングすることを禁止する法律はありませんので違法行為ではありません。

ただし、PSPを例に挙げると、ゲームのケース裏側に以下の一文があります。

「当社は本ソフトウェアを無断で解析することを禁止します」

これはUMD購入にあたりユーザーがその条文に合意したと見なされる可能性があります。他にも裏面条文で、ソフトウェアを公に「伝達」(いわゆる海賊版配布行為)は当然禁じていますし、これについては明らかな著作権法違反ですが、実際にはソフトウェアの改変自体も禁止との条文もあります。CFWで起動するようパッチすることはソフトウェアの改変にあたる可能性はあります。

現在の著作権法は個人で楽しむ分には複製は合法とされていますし、個人でする解析や改変については具体的にそれを禁止する法律はありません。あくまでもメーカーサイドが禁止していると明言しているだけということです。

つまり、警察に逮捕されることはなくても民事裁判で訴えられる可能性はあるということです。
ゲームのハッキングに関しては個人が購入したゲーム機本体やゲーム自体の所有権は購入者であり、著作権こそ存在していますがたとえばPSPの場合にはソニーから貸与された物ではありません。所有権を持つ者が自分の資産をどのように運用するかはソニーにその範囲を限定されるべきではありません。

つまり、PSPでHomebrewを楽しむために自己資産を運用する行為(CFW)、または運用するための準備行為(ハッキング)自体には違法性はないと考えられます。

問題なのは、違法コピー(海賊版)の存在が、そのハッキングやCFWを前提にしているため明らかに相関関係があると判断されると民事裁判で負けるということです。
